Financial Mediation helps couples reach a solution about the division of wealth and ongoing financial support including any pensions on divorce and business interests on divorce or separation. Finding a reasonable financial solution without using solicitors all the way through can avoid the expense of solicitor led negotiation and court.
We understand that money is a very emotive issue. However in order for mediation to work, you will both need to be open and honest about your respective financial positions.
During financial mediation you will be asked to complete financial statements which set out your individual financial status. During mediation sessions you will be able to ask each other questions in a calm, positive, unbiased environment. This often speeds up the process and allows you to find a fair solution avoiding the costs associated with the traditional legal routes. Sometimes clients have the benefit of accountants, IFAs or their solicitors in some of the meetings and we can tailor the meetings for you as needed.
We see clients who are married and wish to divide their property, pensions and assets as well as unmarried couples where there is property or business interests; with or without children.
Mediation is not the same as legal advice however it can work effectively alongside the legal process. When you reach a financial solution, a Memorandum of Understanding is drawn up. You would take this to your solicitors for them to prepare a court order (“consent order”) to reflect the proposals. You would not then need to go to court yourselves.
The average number of financial mediation sessions is three to five sessions although arrangements may be resolved in fewer or more sessions.
