Hybrid Mediation

Hybrid Mediation, face to face or online.

Solicitors can be involved in mediation if both clients agree. There could be one or several meetings with solicitors present online or in person. Nicolette Zarka is able to facilitate hybrid mediation.

Hybrid mediation is different as it is a way of getting closer to an agreement, often in separate rooms initially and sometimes with solicitors present.  The mediator would understand from each client what the issues are and explore options separately.  When the mediator understands that synergies arise and that there is a suggestion that the other client may be interested in they may discuss that with the other client and try to work out a mutual way forward.  Solicitors can be on hand to advise and assist along the way but not always.  With Hybrid mediation the mediator is still neutral but both clients would sign an agreement to say that the mediator can hold confidences until such time as it is agreed otherwise.

Hybrid mediation is more expensive for clients than traditional mediation as solicitors can be present too. However, it can be a useful process where there are more complex assets and where one or both clients would like the support and advice of their solicitor at the same time as the meeting.

Nicolette has trained with Resolution in Hybrid mediation and is also a Civil and Commercial Mediator through ADR Group.
